Law issues gain in court? I live in Spokane Washington and if you did not know a week ago we had about 5 feet of snow. My father and I flew out of town until today and when we got back my car was towed.
After leaving a ton of snow melted and revealed that there was a sign prohibiting parking and my car was illegally parked. Me agree that it was, but it was covered with snow and Burm was about 6 feet high because the snow plow put the snow there. The other cars parked there recently but we have been towed and charged the fine to be towed. Not only that, but we left last Sunday and they did not tow me up last night.
It was four days that not a single person who turns it noticed that I was parked in a place I should not be. My father and I have pictures showing other signs are still covered and other evidence of why we should not have paid.
Are we on the right and we will win this case in Small Claims Court?
Thank you,
Oh an one of the guys who work in the office said it was our responsibility to know that we should not park there, even though the sign was completely covered with snow. Is it total bull **** or what?
In fact, the courts consider that you must know the laws and he wouldnt really small claims court since the amount of fines and your car was towed by order of the state.
You will most likely lose this battle. they feel that you have lived in the city long enough to know better.
I could be wrong and you could win but I'm just giving you advice.
If it is private land, then obviously they have not had to tow it so snowplows could clear the street to traffic. So they made a decision to have you towed (curiously, after a long period), because they just want. So that leaves you to try to get your money back for the towing and impound fees. Regarding your responsibility to know this is a sign that hid it difficult to apply enforce.I think you're more into the law here, but it can not in court according to each ones attitude . Good luck with it.
