Car Recovery Insurance

I was involved in a car accident with the fault of another driver and he agreed completely and the same thing happened in the police report. After the accident I found my car insurance policy has failed during a period of a month. Later, I realized and renewed my contract, but certainly not covering both the accident. I paid NCF and penaty points. Now my car is in recovery. Will my insurance co. help me to claim the loss? If no How can I claim a loss. Btw Insurance Co both drivers. are the same.
